The protection of your personal data is very important to SMB Holding GmbH (hereinafter “we”, “us”) and its subsidiaries (together “SMB”).

We process your personal data exclusively in accordance with the provisions of the Austrian Data Protection Act and the Basic Data Protection Regulation (GDPR– Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, on the free movement of such data and repealing Directive 95/46/EC) and the Data Protection Act.

You as a user of our website agree to the data processing in the sense of this declaration.

In the following we inform you about us as well as about type, extent and purpose of the data collection and use as well as about your rights:

2. Collection and processing of data

We process the personal data that you provide to us as a user of the website and/or as a customer, for example within the framework of an enquiry.

The legal basis for data processing is as follows

The initiation and performance of the contract pursuant to Art. 6 (1) (b) GDPR. In order to be able to process your enquiries to your complete satisfaction, we need your data.

Legal obligations pursuant to Art. 6 para. 1 lit. c GDPR, which we must fulfil, such as legally prescribed storage and documentation obligations.

Legitimate interests of our company within the meaning of Art 6 para. 1 lit f GDPR and legitimate interests within the meaning of Art 6 para. 1 lit f GDPR, which are pursued by a third party, e.g. we would like to inform you as a data subject of our offer up-to-date and targeted about innovations and offers of our products, or invite you to events on a case-by-case basis.

3. Use and disclosure of personal data

No automated determination of directly personal data takes place on our website. Only if you actively enter personal data, e.g. your name, address or e-mail address, do you disclose your data to us.

Insofar as you have made personal data available to us as a user of our website and/or customer, we use this exclusively for the following purposes:

  • to answer your inquiries
  • for processing contracts
  • for technical administration
  • for information about our services and products. Only with your separate consent will we use your data to send advertising, by e-mail, e.g. newsletters

Which data is collected can be seen from the respective input forms. By submitting such forms, you accept that we will contact you for the stated purpose by e-mail or other means if indicated by you. The consent can be revoked at any time in writing. If necessary, the data will be passed on within the SMB to a subsidiary concerned with the request. A transfer to third parties does not take place.

This website does not create any personal user profiles.

Certain applications log your IP address temporarily. It is not possible for us to assign your IP address to other personal data, except in the cases described above if you have given us your data yourself.

Personal data will only be passed on to third parties or otherwise transmitted, if this is necessary for the purpose of contract processing or for billing purposes or if you as a user of the website and/or customer have given your prior consent. As a user of the website and/or customer, you have the right to revoke your consent at any time with effect for the future.

The deletion of the stored personal data takes place if you as the user of the website and/or customer revoke your consent to the storage and if your data is no longer necessary for the fulfilment of the purpose pursued with the storage or if their storage is or becomes inadmissible for other legal reasons. Data for accounting and bookkeeping purposes are subject to the legal obligation to retain data in accordance with the Federal Tax Code and are not affected by a request for deletion.

Should your data processed by us not be correct, please inform us. We will correct this immediately and inform you about it. In the event that you no longer wish your data to be processed by us, please inform us informally. Of course, we will delete your data immediately and inform you about it. Should compelling legal reasons stand in the way of a deletion, we will inform you immediately.

In addition, you have the right to restrict processing and data transfer. If you believe that we have violated Austrian or European data protection laws when processing your data and have thereby violated your rights, please contact us so that we can clarify any questions you may have. Of course, you also have the right to complain to the data protection authority or a European supervisory authority or to appeal to the courts.

5. Automated storage of information (logfiles)

Server Logfiles

The operator of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Website visited
  • Time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used
  • IP address used

The data collected are only used for troubleshooting and to improve the website. The server log files are completely deleted after 14 days, unless there are specific indications of illegal use.
This data is not combined with other data sources.
The basis for data processing is Art. 6 para. 1 lit. f GDPR, which allows the processing of data to fulfil a contract or pre-contractual measures.

6. Cookies, social plugins and other analysis tools from third parties

6.1 General information on cookies

Our website uses so-called “cookies” to make our offer more user-friendly, effective and secure.

A cookie is a small piece of data that can be stored on your hard drive. This data record is stored by the Web server that you use to access your Web browser (e.g. Internet Explorer, Netscape Navigator) have established a connection, created it and then sent it to you. Two types of cookies are used on this website:

Session cookies: These are temporary cookies that remain in the cookie file of your browser until you leave our website and are automatically deleted at the end of your visit.

Persistent cookies: For better usability, cookies remain stored on your end device and allow us to recognise your browser the next time you visit.

Third-party cookies come from providers other than the operator of the website. For example, they can be used to collect information for advertising, custom content, and web statistics.

Most browsers are set by default to accept all cookies. You can set your browser so that you are informed when cookies are set and only allow cookies in individual cases, accept cookies for specific cases or generally exclude them and activate automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of our website may be restricted.

You can remove cookies stored on your PC at any time by deleting the temporary Internet files yourself.

Change cookie settings6.2 Analytics

When you visit our website, your surfing behaviour can be statistically evaluated if you have activated this option on our cookie banner. This is mainly done with cookies and so-called analysis programs. Your surfing behaviour is analysed anonymously; surfing behaviour cannot be traced back to you. You can object to this analysis, the storage and use of your data at any time by deactivating the options in our cookie settings.

a) Matomo

This website uses the open source web analysis service Matomo. Matomo uses “cookies”. These are text files that are stored on your computer and that enable your use of the website to be analysed. For this purpose, the information generated by the cookie about the use of this website is not stored on the server of a third party, but on our own server.

The storage of Matomo cookies and the use of this analysis tool are based on Art. Paragraph 1 lit. f GDPR. The website operator has a legitimate interest in the anonymised analysis of user behaviour in order to optimise both its website and its advertising.

The information generated by cookies about the use of this website will not be passed on to third parties. They are only evaluated within the corporate group.
You can prevent the storage of cookies by setting your browser software accordingly.

If you do not agree to the storage and use of your data, you can deactivate the storage and use in the cookie settings. In this case, an opt-out cookie is stored in your browser that prevents Matomo from storing usage data. If you delete your cookies, this means that the Matomo opt-out cookie will also be deleted. The opt-out must be reactivated when you visit our website again. Matomo cookies remain on your device until you delete them.

Matomo is set on the server side so that the “Do Not Track” settings of the browser are observed. In addition, the last 2 bytes of the IP address are deleted. The visitor logs are automatically deleted after 14 days, archived reports are cleaned up and deleted after 6 months.

b) Google Maps

This website uses Google Maps to display map information. When Google Maps is used, Google also collects, processes and uses data on the use of the Maps functions by visitors to the websites. For more information about Google’s data processing, please see Google’s privacy policy at
https://www.google.at/intl/de/policies/privacy/. There you can also change your settings in the Privacy Center so that you can manage and protect your data.

7. Application data

By submitting your application documents you agree that personal data such as name, title, address, telephone number, date of birth, education, professional experience, salary expectations and the data and images contained in the cover letter, curriculum vitae, certificates or other documents sent will be processed by SMB Holding GmbH for the purpose of storage, merging and making available in an applicant database.

The data provided will be stored in the SMB Holding GmbH database for twelve months for the purpose of processing the enquiry and in the event of follow-up questions. Your data will not be passed on to third parties without your consent. Data processing is carried out on the basis of the legal provisions of Sect. 96 para. 3 TKG and Art. 6 para. 1 lit a (consent) and lit b (necessary for fulfilment of the contract) of the GDPR.
